SUNBURN: RULES VIOLATED WHILE GRANTING PERMISSION – HC

The High Court on Monday in a Public Interest Litigation related with noise pollution during Sunburn EDM 2022 has directed the organiser company and the Deputy Collector who had issued the permission dated 28.12.2022 under the Noise Pollution Rules to file affidavits by 14 March giving full details about the application and how the same was processed.

The High Court noted that the Chief Secretary has filed a preliminary report and further directed him to file the final report within 15 day. The High Court also asked the Chief Secretary to look into the process by which permission was granted on 28.12.2022 based upon the application which was inwarded only on 27.12.2022.

The High Court observed that atleat prime facie it seems that related guidelines and rules was violated while granting permission for the EDM. The High Court also asked the Chief Secretary to look into the notification dated 05.01.2022 containing the Department of Environment and Climate Change action plan in the context of the Noise Pollution Rules.

Adjourning the hearing for 15 March, the High Court also directed the Chief Secretary to report on the officers who were involved in this process of grant of permission.
